There are at least three, and at times four, elements to Tenth Amendment challenge to federal action, each of which must be shown in order for challenge to be successful: (1) federal action must regulate "state as a state", (2) federal action must regulate matters that are indisputable attributes of state sovereignty, (3) state's compliance with federal action or statute must directly impair state's ability to structure integral operations in areas of traditional governmental functions, and (4) in situations where there is weighty federal interest, state must show that nature of federal interest advanced is not so great that it justifies state submission to federal action. - in funds "State entity may not rely upon Tenth Amendment to avoid or disavow as involuntary its compliance with condition attached to receipt of federal funds. U.S.C.A. Const. Amend. 10. cite as 713 F.2d 370 (1983)
